Lagoon Shooter Acquitted of Attempted Murder

Jesse David Wilson did not react when the verdicts were read this morning.

A Foster City man who shot and wounded two other men during an argument over noise has been found not guilty of two counts of attempted murder in San Mateo County Superior Court.

Jesse David Wilson, 41, was also found not guilty of two lesser charges of attempted voluntary manslaughter. The jury of 10 women and two men deadlocked on five remaining counts of assault with a deadly weapon, and Judge John Grandsaert declared a mistrial on those charges.

Wilson did not react when the verdicts were read this morning. He was arrested on July 9, 2010, hours after he shot Steve Dimond and Anthony Cook outside his ground-floor unit at the Beach Cove Apartments. During the two-week trial, Wilson testified that he had acted in self-defense that night, and that he had gone outside with a .38-caliber handgun because he heard a woman scream and what sounded like a fight.

Shortly after midnight, Cook, Dimond, their wives, and a friend had decided to go boating on the lagoon after drinking at a concert in Foster City. A kayak carrying three of the revelers overturned, causing one of the women to scream. A neighbor of Wilson's who is Asian went outside to ask the boating party to quiet down. He was chased back inside his apartment under a barrage of racial slurs, according to defense attorney William Locke.

Wilson armed himself and went outside to see if someone needed help, Locke said. When the boating party saw that Wilson had a gun, they rushed him to try to disarm him, according to Locke. Wilson fired the gun twice during the fight that followed.

Dimond was shot in the back and suffered a collapsed lung, and Cook was shot in the abdomen. Both men survived, and testified that Wilson had shot them before they started to punch him and beat him to the ground. Wilson suffered a broken orbital bone and multiple cuts and bruises.

Wilson, Locke and deputy district attorney Brian Donnellan will be back in court on Feb. 22 to determine what will be done regarding the five assault charges on which the jury deadlocked.

Glad he was found not guilty. If they were really shot before they beat him up, they must be supermen. If I was shot in the back or the stomach, I'd be on the ground in pain and crawling to the nearest hospital.

I think it's crazy! Mr Wilson changed his story several times and ended up placing blame on the heavier set man b/c it made it look more real. The first man that got shot even testified to being shot first b/c he tried to grab the gun from Mr Wilson. Mr Cook only tacked Mr Wilson b/c he just shot his friend. They struggled for the gun for about a minute until another shot went off and that is when Mr Cook finally got enough energy to hold the gun to the floor and then start punching. No he is not superman, but he was shot in the flank and it was a through in through so it did not hit any vital organs so he was able to disarm Mr Wilson. If these people were so bad, then why didn't they shoot Mr Wilson after getting his gun? Anybody on trial for 7 felony counts is going to try to get out of it the best way he can and unfortuantely the jury was confused about it. He was only found not guilty for the higher charges but he should have at least been charged for 2 counts of assult with a firearm against the two men. When Mr Wilson came out with a gun and showed it to the group, he forfits his right to self defense and from i understand, there was no where for the group to run.

Jesse Wilson pled guilty to 2 counts of Assult to Inflict Great Bodily Injury today in the courtroom. He is not allowed to own a fire arm for 10 years. This will be good for anyone else who accidentally bothers Mr Wilson by making some noise, maybe next time he'll use his pepper spray, better yet, maybe he'll just call the police!!
