Foster City Shooting Probe on Ice While Intruder Recovers

San Mateo man remains hospitalized with multiple gunshot wounds.

An  investigation into the of an intruder who mistakenly entered a Foster City home more than 10 days ago remains on hold while he recovers from multiple gunshot wounds, police said.

The San Mateo man was well inside the home, near a kitchen, when a houseguest opened fire on him in the early morning hours of March 25, police Capt. Jon Froomin said.

The shooting occurred minutes after police received reports of an intruder at the home on the 600 block of Crane Avenue at 4:22 a.m.

The San Mateo man was shot three times - all frontal shots - although police won't say where he was hit. The man suffered serious injuries, but it was not known if the injuries were life-threatening, Froomin said.

Police are receiving regular updates from the man's doctors, Froomin said.

The shooter, a Brentwood man in his 40s, has cooperated with investigators, Froomin said.

No arrests have been made in the case.

"We've completed our investigation of everyone up to this point but the person who was shot," Froomin said.

"We're going to try our best to wait until we're able to give (the San Mateo man) a chance to give a statement before we send the case to the district attorney. They'll look at it and review it and see if it's appropriate to charge anyone in this case."

Police don't consider anyone in the case a flight risk, Froomin said.

Asked if he was comfortable with the Brentwood man's decision to open fire on the intruder, Froomin declined to comment.  

Police believe the  San Mateo man had been out drinking with friends in the hours before the shooting and thought the home he entered belonged to a friend.

"I think we have a clear understanding of what took place based on who we've spoken to so far," Froomin said.
