Davis-Sterling Act Will Have Major Changes in 2014 To Your HOA's

In 2014 The Davis-Sterling Common Interest Develop Act, (Commonly referred to as the Davis-Sterling Act) will have changes that will force HOA's to make changes your governing documents.

The Davis-Sterling Act is the primary set of laws that govern common interest developments and HOA's in California. This set of laws was enacted in 1985 to establish statutory framework that regulates common interest developments.

One of the changes involves the granting of exclusive use of common area to association members, such as creating a handicap parking space.

A very specific, and important, substantive addition to the Davis-Sterling Act covers board members' conflicts of interest. Civil Code Section 5350 will prohibit a Board Member from voting on a variety  of matters that concern himself/herself, including discipline of the board member.

There are too many changes to list here, for more information contact your management company for a complete list of changes. Also, inquire about when the governing documents will be changed.

This information comes directly from the Echo Journal, a publication that serves community associations.
